TapSafe Terms of Use
Effective date: September 17, 2025
These Terms govern your use of the TapSafe app and website provided by KVEX OÜ (“TapSafe”, “we”, “us”, “our”). By using TapSafe you agree to these Terms.

1) Safety disclaimer (read this first)
TapSafe is a communication aid — not a substitute for calling your local emergency number. In immediate danger, call emergency services first. TapSafe depends on device battery, GPS, connectivity, carriers, and user input; delivery and accuracy are not guaranteed.
2) Who can use TapSafe (eligibility & account)
You must be 18+ or the age of majority in your jurisdiction and comply with applicable laws. Keep your credentials secure and accurate. You are responsible for ensuring people you add as recipients consent to receive messages from you.
3) What TapSafe provides (service description)
TapSafe lets you configure emergency buttons, store trusted contacts, and send alerts that can include your location. Some features require background location and notifications. Features may evolve over time.
4) Subscriptions, trials, billing, and pricing
- Auto-renewing subscriptions are billed by Apple or Google. Your plan renews unless cancelled at least 24h before period end.
 - Manage/cancel via your platform settings. Prices/taxes may vary by region.
 - Refunds are handled by Apple/Google under their policies.
 - If you cancel, access continues until the end of the paid period.
 - If a trial is offered, unused portions may be forfeited upon purchase unless your store’s policy says otherwise.
 - We may change pricing or plans; if changes affect you, we’ll provide notice as required.
 
5) Messaging, credits, and fair use
You are responsible for the content you send and the recipients you choose; carrier charges may apply. To protect users and carriers, we may rate-limit, require credits, throttle, or suspend abusive or excessive messaging. No false emergencies, spam, or unlawful content.
5.1 Service communications (non-marketing)
You consent to receive operational emails/SMS (e.g., verification codes, critical service notices). These are not marketing. You can control certain notifications in device settings; disabling them may impact functionality.
6) Acceptable use
Don’t use TapSafe for unlawful acts, harassment, stalking, privacy violations, or to interfere with the Services. Don’t reverse engineer, probe, or bypass security. Don’t misuse location features to track others without lawful basis and consent.
7) Location & permissions
Some features require location, notifications, or contacts permissions. Granting access is voluntary, but certain features won’t work without them. See the Privacy Policy in-app for details.
8) Third-party services & app stores
We integrate with Apple/Google in-app purchases, RevenueCat, Superwall, carriers, and infrastructure providers. Their terms may also apply.

9) Intellectual property & license
TapSafe and its content are owned by KVEX OÜ or licensors. We grant you a personal, non-transferable, revocable license to use the app per these Terms. You may not copy, modify, or redistribute without permission.
10) User content & feedback
You retain rights in content you submit (e.g., names you enter for contacts). You grant us a non-exclusive license to host/process it to provide the Services. If you send feedback or ideas, we may use them without obligation.
11) Open-source notices
TapSafe includes open-source components under their respective licenses. Notices are available upon request or in the app where provided.
12) Privacy
Our Privacy Policy explains what we collect and why, including location, contacts you add, and analytics. It forms part of these Terms.
13) Service changes; beta features
We may add, change, or discontinue features. We may label features as beta; these may be unstable and can change or end at any time.
14) Security
We use reasonable safeguards (e.g., encryption in transit, access controls). No system is 100% secure.
15) Warranty disclaimer
The Services are provided “as is” and “as available.” We disclaim all warranties to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
16) Limitation of liability
To the fullest extent permitted by law, KVEX OÜ isn’t liable for indirect, incidental, special, consequential, or punitive damages, or loss of data/profits. For other claims, our total liability is limited to the greater of (i) amounts you paid for TapSafe in the 12 months prior to the claim, or (ii) EUR 100 — except where such limits aren’t permitted by law (including death/personal injury caused by negligence, fraud, or gross negligence).
17) Indemnity
You agree to indemnify us for claims arising from your misuse of the Services, violations of these Terms, unlawful messaging, or failure to obtain recipients’ consent.
18) Export controls & sanctions
You represent that you are not located in an embargoed country or on a restricted party list and will not use the Services in violation of export or sanctions laws.
19) Termination & deletion
You may stop using TapSafe at any time. We may suspend or terminate access for violations, abuse, fraud, or risk to the service or others. Subscription cancellation is managed via Apple/Google (Section 4). To request account/data deletion, use any in-app option (if available) or email contact@tapsafeapp.com from your account email.
20) Governing law & venue
These Terms are governed by the laws of Estonia, without regard to conflict-of-laws rules. Courts of Estonia have jurisdiction, except where local consumer law provides otherwise.
21) Changes to these Terms
We may update these Terms; material changes will be notified in-app or by email. Continued use after changes means you agree to the revised Terms.
22) Miscellaneous
Severability. If a term is unenforceable, the rest remains in effect.
No waiver. Failure to enforce isn’t a waiver.
Assignment. You may not assign without consent; we may assign to affiliates or a successor.
Force majeure. We aren’t liable for delays/failures beyond our reasonable control.
Entire agreement. These Terms + the Privacy Policy are the entire agreement.
